The special provisions on page 24 call out" Removal and Disposal of Regulated Substances" along with additional testing/procedures. No pay items are included for this work. Were pay items left off or is the special provision not required?
The special provision REMOVAL AND DISPOSAL OF REGULATED SUBSTANCES (BDE) revises Section 669 of the Standard Specifications for Road and Bridge Construction as referenced in Article 107.19 and is therefore included on every construction contract. Regulated substances were not found during the design phase of this contract. Had there been regulated substances, pay items and a special provision detailing the location of these substances would have been included in the contract. In the event that regulated substances are encountered during construction, this special provision would then be used. (01/10/2019)
